Legal argumentation is an important part of legal action. The legal argument has three argument participants: the prosecution, the defense and the trial. Taking the current legal system of our country as an example, in criminal proceedings, the three main subjects are the public prosecutor (the prosecution), the defendant (the defense) and the judge (the adjudicator). The prosecution's job is to demonstrate their claim, legal defense duty is to refute the other claims is not legitimate, and the responsibilities of the prescriptions according to both sides of the argument made in accordance with legal procedures and norms of justice, and the decision is based on the good legal arguments.

In the court debate, the argument is always biased because of the interests or positions of the parties concerned, especially when the evidence is presented to them. The judges should try their best to gain insight into these prejudices, and try to eliminate them in order to obtain a fair judgment and make a legal argument that is legally convincing. Therefore, the legal argumentation that we are talking about is actually a kind of conversational argument, where the prosecution and the defense respectively represent the demonstrator and retort of the dialogue, and the judges represent the referee in the dialogue.
